Case of negligence.. detailed advice? what cases should i be looking at?

would the club of a rugby player who kicked a ball over the perimeter fence be liable for negligence should the ball hit a car with a driver who has no license or insurance who dies as a result of the ball hitting the car. Short answer is Yes. First of all get rid of all the irrelevant language. In this case no license and insurance. This has nothing to do with the ball hitting the car and killing the driver.





';Few times a year, the ball goes over the fence';. Few times, is one too many; even it had never gone over the fence this would not necessarily mean the rugby club would not be liable.





The club was on notice that the ball had previously gone over the fence and it was foreseeable that it could cause damage or injury to the passing motorists; yet they failed to take proper precautions; meaning a higher net. The club owed a duty of care to the drivers near the field. There were no good reason to compromise the public safety and for allowing the rugby games to continue without proper safety measures.





Liability would be limited to drivers in the immediate vicinity because their loss, including death was foreseeable.
